2. FILING A DMCA TAKEDOWN NOTICE

  1. Identification of copyrighted work: Detailed description of the work claimed to be infringed (if multiple works, representative list)

  2. Identification of infringing material: Description of material claimed to be infringing, sufficient information to locate it (URL, page location, description of where it appears)

  3. Contact information: Your full legal name, mailing address, telephone number, email address

  4. Good faith statement: "I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."

  5. Accuracy statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

  6. Signature: Physical or electronic signature (typing your full legal name constitutes electronic signature)

Warning

You may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that material is infringing under 17 U.S.C. § 512(f). Ensure you own the copyright or are authorized, the use is not authorized, and consider fair use before submitting.

3. OUR RESPONSE TO TAKEDOWN NOTICES

Review Process

Upon receiving valid notice, we will:

  • Review for completeness (all required elements present)

  • Verify information provided

  • Take prompt action if valid

Actions Taken

If notice is valid:

  • Remove or disable access to allegedly infringing content

  • Notify the client whose content was removed

  • Provide copy of notice to client (may redact personal information)

  • Document incident and track repeat infringer status

Incomplete Notices

If notice lacks required elements, we may request additional information or decline to act until complete notice is provided.

Response Time: Typically within 24-72 hours of receiving valid notice.

4. COUNTER-NOTICE PROCEDURE

If your content was removed and you believe removal was a mistake or misidentification, you may file counter-notice.

  • Identification of removed material: Description of material removed and location before removal

  • Good faith statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed as a result of mistake or misidentification."

After Filing Counter-Notice

If we receive valid counter-notice:

  • Forward copy to original complainant immediately

  • Inform complainant we will restore content in 10-14 business days unless they file court action

  • Restore content if no court action filed within 10-14 days

  • Keep content removed if court action filed pending resolution

5. REPEAT INFRINGER POLICY

We terminate accounts of repeat infringers in appropriate circumstances.

Repeat Infringer Defined

Client who has:

  • Received multiple valid DMCA notices resulting in content removal

  • Demonstrated pattern of uploading infringing content

  • Been subject to 2+ substantiated infringement claims

Progressive Enforcement

First Offense: Remove content, send warning, provide copyright education

Second Offense: Remove content, temporary suspension (7-30 days), require written compliance commitment

Third Offense or Severe/Willful Infringement: Permanent account termination, no refund, prohibition from new accounts, potential referral to authorities

Appeals

Submit written explanation to [email protected] with evidence prior takedowns were erroneous or compliance measures implemented. Appeals reviewed case-by-case. Our decision is final.

6. FAIR USE CONSIDERATION

U.S. copyright law recognizes "fair use" as legal defense to infringement. Fair use factors:

  • Purpose and character of use (commercial vs. educational)

  • Nature of copyrighted work

  • Amount and substantiality used

  • Effect on potential market value

Copyright Owners: Consider fair use before submitting takedown notice. Courts require copyright owners to consider fair use.

Clients: If you believe your use is fair use, you may file counter-notice explaining why. Determining fair use requires legal analysis—consult an attorney if uncertain.

7. CLIENT RESPONSIBILITIES

Clients agree to:

  • Only upload content they own or have permission to use

  • Respect intellectual property rights

  • Not use platform to infringe copyrights

  • Obtain necessary licenses and permissions

  • Not re-upload removed content without permission or valid counter-notice

Violations may result in account termination without refund.

8. LIMITATIONS AND DISCLAIMERS

No Monitoring Obligation: Company has no obligation to monitor content or actively seek infringement. We rely on copyright owners to notify us.

Not Legal Advice: This policy is informational only. For copyright law questions, consult an attorney.

No Judgment on Merits: Our response to notices doesn't constitute judgment on copyright claim merits. Such determinations must be made by courts or party agreement.

Policy Changes: We may modify this policy anytime. Material changes posted with updated date.
